AM23-02 Electrical Vehicle (EV) Charging Stations – City Council and Planning and Zoning Commission to conduct a public hearing to consider amendments and changes to the Comprehensive Zoning Ordinance No. 82-73, same being Appendix D of the Code of Ordinances, as follows: to create and amend definitions in Section 12, Definitions; allow electric vehicle charging stations as a conditional City Council January 16, 2024 Page 2 use in Section 22, “R-MF”, Multifamily District Regulations, Section 25, “CC”, Community Commercial District, Section 26, “HC”, Highway Commercial District, Section 28, “CBD”, Central Business District, Section 31, “LI”, Light Industrial District, Section 32, “BP”, Business Park District, and Section 38, “GU”, Governmental Use District; and create use specific standards in Section 42, Supplementary District of the Zoning Ordinance relative to electric vehicle charging stations and their supply equipment.]

GOOD EVENING, HONORABLE MAYOR, MEMBERS OF THE CITY COUNCIL, MADAM CHAIR AND MEMBERS OF THE PLANNING AND ZONING COMMISSION.

THIS FIRST JOINT PUBLIC HEARING ITEM IS A TEXT AMENDMENT TO THE ZONING ORDINANCE.

IT IS A REQUEST TO AMEND VARIOUS SECTIONS OF THE ZONING ORDINANCE RELATIVE TO ELECTRIC VEHICLE CHARGING STATIONS AND THEIR SUPPLY EQUIPMENT.

THE PLANNING AND ZONING COMMISSION HELD A SERIES OF WORKSHOPS THAT BEGAN ON AUGUST 1ST, 2023 AND CONTINUED ON ONTO OCTOBER 17TH NOVEMBER 21ST, DISCUSSING ELECTRIC VEHICLE CHARGING STATIONS AS A NEW AND UNLISTED USE IN NON RESIDENTIAL ZONING DISTRICTS AND MULTIFAMILY ZONING DISTRICTS, AND THE NEED FOR DEFINITIONS AND USE SPECIFIC STANDARDS PROVIDING DIRECTION ON APPROPRIATE LOCATIONS, BUFFERING, SIGNAGE AND AN APPROVAL PROCESS.

AS PART OF THIS WORKSHOP WORK, THE COUNCIL ALSO APPROVED A SIX MONTH MORATORIUM ON SEPTEMBER 5TH, 2023 THAT WOULD PROHIBIT THE INSTALLATION OF NEW AND REPLACEMENT EV CHARGING STATIONS.

THIS IS SET TO EXPIRE ON MARCH 5TH, 2024.

THE AMENDMENT BEFORE YOU AND IN YOUR COUNCIL BACKUP MATERIALS INCLUDES TWO NEW DEFINITIONS TO SECTION 12 OF THE ZONING ORDINANCE FOR EV CHARGING STATIONS AND EV SUPPLY EQUIPMENT.

IT ALLOWS FOR EV CHARGING STATIONS IN SEVEN ZONING DISTRICTS WITH APPROVAL OF A CONDITIONAL USE REQUEST, INCLUDING THE RESIDENTIAL MULTIFAMILY DISTRICT, COMMUNITY COMMERCIAL HIGHWAY, COMMERCIAL CENTRAL BUSINESS DISTRICT, LIGHT INDUSTRIAL BUSINESS PARK DISTRICT, AND GOVERNMENTAL USE DISTRICT AND WITHIN SECTION 42 USE SPECIFIC STANDARDS ARE ESTABLISHED IN SUBSECTION I, WHERE FOR NEW EV CHARGING STATIONS, A BUILDING PERMIT WOULD BE REQUIRED.

A CHARGING STATION PARKING IS IN ADDITION TO ANY REQUIRED PARKING SPACES FOR ALL OF THE OTHER USES ON THE PROPERTY.

THAT SIGNAGE BE APPROVED AS PART OF THE CONDITIONAL USE PERMIT PROCESS, THAT THEY MAY NOT BE LOCATED IMMEDIATELY ADJACENT TO PUBLIC RIGHTS OF WAY, AND IF LOCATED WITHIN 50FT OF ADJACENT RESIDENTIAL USES OR DISTRICT SCREENING AND BUFFERING BE PROVIDED.

SUPPLY EQUIPMENT WOULD NEED TO BE PLACED ON GROUND MOUNTED PADS AND TRANSFORMERS WOULD ALL NEED TO BE EITHER UNDERGROUND OR GROUND MOUNTED AND NOT AERIAL, AND THAT EVERY APPLICATION WOULD REQUIRE UTILITY WILL SERVE LETTER FROM THE LOCAL ELECTRIC DELIVERY COMPANY.

IN ADDITION, EMERGENCY SHUT OFF EQUIPMENT WOULD NEED TO BE PROVIDED FOR FIRST RESPONDERS AND FIRE AND POLICE, AND THAT THESE EV CHARGING STATIONS BE PROHIBITED IN PARKING STRUCTURES, WHICH WOULD BE CONSISTENT WITH RECENTLY ADOPTED UPDATED BUILDING CODES AND FIRE CODES.

I KNOW THAT THERE ARE SOME THAT WOULD RATHER NOT HAVE THIS APPROVAL PROCESS IN PLACE, BUT WE'VE BEGUN TO SEE THESE EV STATIONS GOING UP EVERYWHERE, AND THERE'S NO ABILITY FOR US TO MAKE SURE THAT THEY'RE NOT TAKING AWAY REQUIRED PARKING AND THAT THEY'RE NOT PUTTING THEM IN IN PLACES THAT ARE VERY UNATTRACTIVE FOR PEOPLE THAT ARE EITHER WALKING OR DRIVING BY AND SO FORTH.

SO I KNOW THAT IT'S BEEN A TOUGH ROAD TO GET TO WHERE WE ARE.

AND I KNOW THAT THERE'S BEEN INPUT FROM, RELATIVE TO THE STATE FIRE CODE REQUIREMENTS TO MAKE SURE IT'S SAFE IN GARAGES AND SO FORTH.

SO I KNOW THAT IT'S, A NEW THING.

WE PROBABLY HAVE MORE OF THESE TYPE THINGS WE HAVE TO DEAL WITH IN THE FUTURE.

AND I'D LIKE TO RAISE A CONCERN OVER THIS AMENDMENT, BECAUSE WHAT WE'RE DOING HERE IS, WHILE IT'S FINE, MY STORE DOES NEED TO REPAIR AND SERVICE THESE ELECTRIC VEHICLES, AND WE HAVE SEVERAL OF THESE STATIONS.

IN FACT, WE'RE ALWAYS INSTALLING NEW ONES OR REPAIRING THEM OR UPGRADING THEM AS THE MANUFACTURER REQUIRES IT, OR AS OUR CUSTOMERS REQUIRE IT.

AND WE'VE BEEN LUMPED INTO THIS.

BUT NOT ONLY IS IT THAT, BUT WE'VE TAKEN ALL THREE LEVELS OF ELECTRIC CHARGING STATIONS, AND WE'VE MADE THEM ALL THESE ELECTRIC CHARGING STATIONS THAT NEED A CUP, A LEVEL ONE CHARGING STATION, FOR EXAMPLE.

IT RUNS THE POWER OF ABOUT YOUR MICROWAVE.

IF YOU PLUG IN YOUR ELECTRIC CAR INTO THAT, YOU MAY TAKE 3 OR 4 DAYS TO FULLY CHARGE IT.

IT IS NOT A BIG DEAL.

A LEVEL TWO WILL PROBABLY CHARGE YOUR CAR OVERNIGHT, MOST PEOPLE HAVE THESE IN THEIR HOME GARAGE.

IT RUNS ABOUT THE POWER OF YOUR AC AIR CONDITIONER UNIT IN YOUR HOUSE.

IT'S KIND OF A BIGGER DEAL, BUT NOT THAT BIG OF A DEAL.

THE BIG DEAL IS THESE LEVEL THREE CHARGING STATIONS.

THESE THINGS SUCK DOWN MORE POWER THAN A 20 STORY OFFICE BUILDING.

AND I THINK IT'S THIS TRULY THAT YOU ARE SEEKING TO REGULATE.

AND OF THAT I APPROVE THESE THINGS.

IT TAKES ME SIX MONTHS TO GET A PERMIT TO PUT IN ONE OF THESE THINGS FROM THE UTILITIES.

AND I AGREE, GOING THROUGH THE CUP PROCESS AND MAKING SURE THE CITY IS OKAY WITH WHERE I'M PUTTING IT IN MAKES A LOT OF SENSE.

BUT THE OTHER ONES, I THINK WE'RE OVERDOING IT JUST A BIT BY LUMPING THEM INTO THIS SAME DEFINITION.

I'D ALSO LIKE TO KNOW THAT THIS REQUIREMENT IS ONLY ON THE DEALERSHIPS DESIGNATED CC COMMERCIAL OF MY DEALERSHIP.

YOU'VE GOT THE NISSAN DEALERSHIP, YOU'VE GOT THE CHRYSLER DEALERSHIP.

EVERY OTHER DEALERSHIP IN TOWN IS IN A DIFFERENT TYPE OF ZONING DISTRICT BY MY REVIEW, AND SOME OF THEM ARE ON AIRPORT PROPERTY.

NONE OF THOSE DEALERSHIPS WOULD BE TOUCHED.

AM23-08 Short Term Rentals – City Council and Planning and Zoning Commission to conduct a public hearing to consider amendments and changes to the Comprehensive Zoning Ordinance No. 82-73, same being Appendix D of the Code of Ordinances, as follows: to create and amend definitions in Section 12, Definitions; create use-specific standards in Section 21, Reserved; allow a new short-term rental use as a conditional use in Section 22, “R-MF”, Multifamily District Regulations; and establish parking standards in Section 56, Off-Street Parking Requirements relative to short-term rentals including associated regulations.]

SHORT TERM RENTALS ERICA MAROHNIC.

THIS IS A REQUEST TO AMEND VARIOUS SECTIONS OF THE ZONING ORDINANCE RELATIVE TO SHORT TERM RENTALS AND ASSOCIATED REGULATIONS.

THERE ARE INSTANCES WHERE THE CITY COUNCIL FINDS THAT ENACTING A PERMITTING PROGRAM FOR SHORT TERM RENTALS WILL SERVE THE BALANCE THE RIGHTS OF ALL STAKEHOLDERS IN THE CITY THROUGH A FAIR AND BALANCED REGULATORY FRAMEWORK THAT PERMITS SHORT TERM RENTALS AND LIMITED LOCATIONS AND UNDER CERTAIN CIRCUMSTANCES, BUT ENSURES THAT SHORT TERM RENTALS DO NOT BECOME A NUISANCE TO SINGLE FAMILY NEIGHBORHOODS.

THEREFORE, THIS DRAFT ORDINANCE SEEKS TO STRIKE A BALANCE AND ALLOW FOR SHORT TERM RENTALS WITHIN TWO EXISTING MULTIFAMILY ZONING DISTRICTS WITH APPROVAL OF A CONDITIONAL USE PERMIT AND SUBJECT TO CONDITIONS.

THIS AMENDMENT PROPOSES NEW DEFINITIONS WITHIN SECTION 12 FOR BOOKING SERVICE, HOSTING PLATFORM, SHORT TERM RENTAL, SINGLE FAMILY AND MULTIFAMILY SHORT TERM RENTALS, OF WHICH SINGLE FAMILY SHORT TERM RENTALS CONTINUE TO BE PROHIBITED, AS HAS BEEN THE CITY'S CONTENTION SINCE 2018.

AND AMENDING SECTION 21, WHICH IS CURRENTLY RESERVED IN THE ZONING ORDINANCE, TO ESTABLISH SOME USE SPECIFIC STANDARDS RELATIVE TO MULTIFAMILY SHORT TERM RENTALS. AND AS PART OF THIS, IT IS PROPOSING TO ESTABLISH, A TWO PRONGED PROCESS.

FIRST, THERE IS THE CONDITIONAL USE REQUEST PROCESS THAT WOULD REQUIRE A PUBLIC HEARING THROUGH THE PLANNING AND ZONING COMMISSION AND CITY COUNCIL TO APPROVE IT WITHIN A MULTIFAMILY DEVELOPMENT, AND THEN ALSO A PERMITTING PROCESS THROUGH THE PLANNING SERVICES DEPARTMENT AND ESTABLISHING THAT PERMITTING PROCESS, INSPECTION PROCESS AND ULTIMATELY REVOCATION PROCESS IF THERE'S NONCOMPLIANCE FURTHER ON DOWN THE ROAD IF THIS WERE TO BE ADOPTED.

SO, LIMITATIONS ON HOSTING PLATFORMS OR BOOKING SERVICES ARE ESTABLISHED AS PART OF SECTION 21, INCLUDING REPORTING REQUIREMENTS ON A QUARTERLY BASIS.

REQUIREMENTS FOR PAYMENT OF HOTEL OCCUPANCY TAX TO THE CITY AND CONSISTENT WITH ALREADY ESTABLISHED ORDINANCES ON A MONTHLY BASIS TO THE FINANCE DEPARTMENT.

BUT THE LIMITATIONS THAT ARE ESTABLISHED AS PART OF THIS AMENDMENT INCLUDE THAT ANY MULTIFAMILY DEVELOPMENT THAT'S ZONED RESIDENTIAL, MULTIFAMILY OR RESIDENTIAL MULTIFAMILY TO THAT, THAT DEVELOPMENT MUST HAVE AT LEAST 50 UNITS OR MORE.

THAT THERE CAN'T BE MORE THAN 3% OF THE AVAILABLE UNITS IN THE DEVELOPMENT UTILIZED FOR SHORT TERM RENTAL PURPOSES, THAT THEY WILL BE PROHIBITED WITHIN OUR HISTORIC TOWNSHIP BOUNDARY OR TRANSIT DISTRICT OVERLAY, AND THEY ALSO CANNOT BE LOCATED WITHIN 500FT OF PROPERTY ZONED FOR SINGLE FAMILY USES.

THIS, IN ESSENCE, ALLOWS SIX MULTIFAMILY DEVELOPMENTS AT THIS TIME IN THE NORTHEASTERN PART OF THE TOWN.

AND A MAXIMUM TOTAL NUMBER OF 63 UNITS THAT CAN BE UTILIZED FOR SHORT TERM RENTAL PURPOSES.

IF THEY AGAIN WERE ABLE TO GO AND APPROVE FOR THE CONDITIONAL USE PERMIT AND THE PERMIT THROUGH THE PLANNING SERVICES DEPARTMENT.

THERE'S A WHOLE HOST OF OTHER CONDITIONS AND USE SPECIFIC STANDARDS OUTLINED HERE AS FAR AS REPORTING REQUIREMENTS AND DESIGN REQUIREMENTS AND PROHIBITIONS ON CREATING ADDITIONAL BEDROOMS WITHIN AN EXISTING MULTIFAMILY UNIT.

IT ALSO ESTABLISHES DEDICATED OFF STREET PARKING AND MINIMUM RENTAL PERIODS OF 24 HOURS, AND PROHIBITIONS ON SPECIAL EVENTS.

THE TEXAS SUPREME COURT, THE APPELLATE COURT AND THE COUNTY COURT HAVE ADVISED THE CITY THAT UNTIL OUR STATE LAW CHANGES ITS LAW FOR PROPERTY OWNERS, THE CITY CANNOT BAN OR TAKE AWAY THE RIGHTS TO RENT THEIR PROPERTY FOR ANY DURATION OF TIME.

IT STARTED IN MARCH 2018 WHEN I WAS IN EIGHTH GRADE.

IT FINALLY ENDED IN OCTOBER WHEN GRAPEVINE CLARIFIED ITS ORDINANCES TO STOP SUCH PARTY HOUSES.

EVERY WEEK, THERE WERE ANYWHERE FROM 30 TO 40 NEW STRANGERS WHO CAME AND PARTIED EVERY, EXCUSE ME? WE COULD HEAR ALL, EVERYTHING THAT WENT ON IN THOSE HOUSES.

OUR NEIGHBORS, OUR NEIGHBORHOODS, ARE VERY CLOSE TOGETHER.

AND THAT'S WHY IT WAS VERY EASY TO HEAR.

THE WORST PART IS THAT I HAVE TWO LEARNING DISABILITIES ADHD AND DYSLEXIA.

AS WELL I HAVE SLEEPING ISSUES.

FOR EXAMPLE, I DO NOT FEEL SAFE ENOUGH TO SWIM IN MY OWN POOL OR GO OUTSIDE IN MY BACKYARD.

THIS YEAR WAS NOT FROM KNOWING WHO THESE PEOPLE WERE AND NOT KNOWING THEIR CRIMINAL HISTORIES.

THE REVISED STR ORDINANCE IS A STEP IN THE RIGHT DIRECTION, BUT OUR WORK IS NOT DONE.

STAY VIGILANT.

SOME WILL TRY AND SKIRT THE ORDINANCE, AND WE ALSO HAVE TO MONITOR COURT CASES.

TEXAS PROPERTY CODE, CHAPTER 92 AS IN PART OF THE TAX CODE, CHAPTER 156, IMPLICITLY PREEMPTS THE CITY'S SHORT TERM RENTALS ORDINANCE FROM 2018.

THIS LAW CAN BE LOOKED UP IN THE CITY'S APPELLATE COURT CASE OF APPEALS NUMBER 021900257 CV ON PAGE 40 OF ITS OPINION.

ON PAGE 46, THE APPELLATE OPINION IS STATED.

TEXAS COMMON PROPERTY LAW PRESERVES THE RIGHT OF LEASING AS A BASIC SACRED PROPERTY RIGHT AND ZONING ORDINANCE HAS ALLOWED SHORT TERM RENTALS TO PROPERTY OWNERS IN THE STATE TO HAVE HISTORIC BASIC PROTECTION FOR THEIR LEASING RIGHTS AND FOR ANY DURATION OF TIME.

IT SEEMS THE HOTELS HAVE THE CITY'S FAVOR SINCE THE 2018, WHEN THE VIN AND MARRIOTT CAME TO TOWN.

THAT'S WHEN IT BEGAN TO BE A PROBLEM FOR RESIDENTS LIKE MYSELF TO RENT OUT THEIR HOMES SHORT TERM.

THE CITY HAS TAKEN OUR TAX DOLLARS AND HIRED ONE OF THE MOST EXPENSIVE LAW FIRMS IN OUR COUNTY TO DRAG OUT THE CURRENT HOMEOWNERS LAWSUIT AGAINST THE CITY FOR FIVE AND A HALF YEARS. AND IT'S STILL NOT OVER.

THE CITY DRAGGED THIS SUIT TO THE TEXAS SUPREME COURT, KNOWING ALL THE WHILE THAT TEXAS PROPERTY LAWS DON'T SUPPORT THEIR STANDING.

SEVERAL OF OUR LOCAL HOMEOWNERS PUT LARGE AMOUNTS OF MONEY TOWARDS PROTECTING THEIR VESTED RIGHTS AND INTERESTS TO LEASE OUR PROPERTY SHORT TERM.

CONTINUING THIS COURSE OF DISCRIMINATION AGAINST SHORT TERM RENTALS WILL SURELY INCITE FUTURE LAWSUITS.

BEEPING CARS, BANGING GATE FOR YEARS, NOT FIXED, IGNORED BY THE NOTIFICATIONS, PEOPLE CUTTING ACROSS MY LAWN TO GO TO AND FROM THE LAKE, ASKING TO GO BACK INTO MY BACKYARD TO RETRIEVE ITEMS BECAUSE THE POOL IN THE DECK ARE EVEN WITH THE TOP OF THE FENCE.

PEOPLE CAN SEE INTO MY HOUSE AND I CAN SEE THEM.

SO TRASH AND BEACH BALLS AND WHATEVER ITEMS CAN EASILY COME INTO MY YARD.

I'VE HAD UBERS GO INTO MY DRIVEWAY, PARTLY BECAUSE THE HOUSE NUMBERS ARE DIFFICULT TO SEE, ESPECIALLY AT NIGHT.

I'VE HAD 24 CARS NEXT TO ME, VALET PARKING, MANY LARGE EVENTS.

THERE'S BEEN FIGHTS, YELLING, POT SMOKING, PHOTO SHOTS, LOTS OF DRINKING, JERRY JEFF WALKER TO RAP MUSIC.

JUST JUST TOO MUCH MORE.

I HAVE TO MENTION THE INFRASTRUCTURE FOR OUR SEWERS.

THEY ARE MADE FOR SINGLE FAMILY HOMES.

PLUMBERS HAVE BEEN THERE NEXT DOOR MANY A TIME.

ONE DAY, TWO DAYS LATER, AFTER THE PLUMBERS WERE THERE, MY TOILET ME ONE PERSON.

DESPITE ZONING THAT GOES BACK FOR MANY YEARS IN GRAPEVINE, APPARENTLY AN INQUIRY WAS MADE BY AN ENTREPRENEUR SEEKING TO OPERATE AN STR IN A RESIDENTIALLY ZONED NEIGHBORHOOD.

IT IS SAID THAT A CITY EMPLOYEE GAVE THE IMPRESSION THAT THERE DID NOT APPEAR TO BE ACTIONS TAKEN TO MAKE STRS COMPLY WITH THE IN PLACE ZONING RESTRICTIONS.

THOSE IN THE STR INDUSTRY USE THAT RESPONSE AS AN EXCUSE TO IGNORE EXISTING ZONING LAWS, BETTING THAT THERE WOULD BE NO CONSEQUENCES, JUST BIG MONEY.

APPROXIMATELY FIVE YEARS AGO, THE STR ISSUE CAME TO A HEAD AND THE COUNCIL VOTED AGAINST ALLOWING THESE COMMERCIAL ENTERPRISES TO OPERATE IN RESIDENTIAL AREAS. THANKS TO THE GRAPEVINE CITY COUNCIL FOR HAVING TAKEN THAT ACTION, IT PUT A A MORATORIUM ON NEW STRS, WHICH I FEEL SAVED OUR FAMILY FROM HAVING AN STR RIGHT NEXT DOOR TO OUR OUR HOME.

I BELIEVE THAT WE WOULD ALL AGREE THAT HAVING AN STR AS YOUR NEXT DOOR NEIGHBOR WOULD BE VERY UNDESIRABLE.

SLIGHTLY ANALOGOUS TO OUR SOUTHERN BORDER SITUATION.

THE PROLIFERATION OF STRS IN GRAPEVINE AND CITIES WORLDWIDE HAS BROUGHT UNWANTED ACTIVITIES, INCLUDING CRIMINAL BEHAVIOR, DOWN UPON LEGAL INHABITANTS. HOMEOWNERS AND LONG TERM RENTERS HAVE THOUGHT THAT THEY HAD BOUGHT AND RENTED HOMES WITH A BLANKET CONTRACT OF OF ZONING ORDINANCES TO PROTECT THEM FROM COMMERCIAL, UNSCRUPULOUS AND UNDESIRED ACTIVITIES, WHICH CAN BE RIGHT NEXT DOOR TO THEM. DALLAS, FOR EXAMPLE, DESPITE THEIR CITY COUNCIL AND A SITTING, A STRONG COALITION HAS NOT BEEN ABLE TO REIN IN THE STR INDUSTRY.

STRS CAN BE GREAT WHEN THEY FOLLOW THE RULES AND DON'T TRAMPLE THE RIGHTS OF OTHERS.

HOWEVER, THE THE HUGE MONEY INVOLVED WILL KEEP THE STR BUSINESS LOOKING FOR WAYS TO SKIRT THE RULES.

SINCE THAT TIME, MORE THAN 40 STRUCTURES HAVE BEEN LIFTED AND MOVED IN THE GRAPEVINE HISTORIC TOWNSHIP IN SUPPORT OF HISTORIC PRESERVATION FOR THE INVOLVEMENT OF THE CITY OF GRAPEVINE STAFF AND MEMBERS OF THE TEXAS ASSOCIATION OF STRUCTURAL MOVERS.

PRESERVING THESE HISTORIC STRUCTURES BY MOVING THEM ENSURES THAT THE HISTORY AND THE HERITAGE OF THE GRAPEVINE PRAIRIE WILL REMAIN AS AN ARCHITECTURAL TESTIMONY FOR FUTURE GENERATIONS.

WE HAVE BEEN ENGAGED FOR A NUMBER OF WEEKS WITH AN ECONOMIC DEVELOPMENT FIRM, PETTIT ECONOMIC DEVELOPMENT ITEM 14 WILL BE A PROFESSIONAL SERVICES AGREEMENT THAT CONTINUES THAT RELATIONSHIP TO COMPLETE THIS PROJECT.

IN WORKING WITH THAT FIRM, WE'VE BEEN MADE AWARE OF DIFFERENT ELEMENTS OF CHAPTER 311 OF THE STATE TAX CODE THAT DOES ALLOW THE PAYMENT OF OPERATING EXPENSES AT TIF PROJECT FACILITIES.

CURRENTLY IN OUR TWO TIFS WE IN EACH OF THEM, WE HAVE GCISD FACILITIES THAT HAVE BEEN FUNDED THROUGH TIF FUNDS.

TIF ONE THE GRAPEVINE MILLS TIF THEN LATER EXPANDED TO INCLUDE THE 185 FUNDS FROM THAT TIF WERE UTILIZED TO FUND MUSTANG PANTHER STADIUM AS A JOINT USE FACILITY BETWEEN US AND THE SCHOOL DISTRICT.

TIF TWO THE GAYLORD TIF INCLUDES GRAPEVINE MIDDLE SCHOOL.

THE FUNDS FROM THAT TIF ARE USED TO PAY THE DEBT SERVICE FOR THAT FACILITY, AND WE CONTINUE TO DO THAT.

SO IN THIS PROPOSAL THAT WE'RE PRESENTING, WE WOULD THEN UTILIZE THE TIF FUNDS TO PAY OPERATING EXPENSES AT THOSE FACILITIES, THEREFORE FREEING UP DOLLARS IN THE GCISD'S BUDGET TO BE REPURPOSED FOR SROS FOR SCHOOLS THROUGHOUT THE DISTRICT.

THIS IS A STRATEGY THAT USES UTILIZES GCISD MONEY.

THE MONEY IN THE TIF CURRENTLY IS MONEY CONTRIBUTED FROM THEIR PROPERTY TAX RATE THAT HAS TO BE USED FOR SCHOOL DISTRICT EXPENSES AND WORKING WITH THE EXECUTIVE TEAM FOR GCISD THIS IS WHAT THEY WOULD LIKE TO USE THOSE FUNDS FOR.

CURRENT FINANCIAL PROJECTIONS.

WE THINK WE COULD FUND SROS TO 2031.

AND WITH CONSERVATIVE FINANCIAL PROJECTIONS.

KIND OF TAKING A STEP BACK IF YOU LOOK ON THE LEFT HAND SIDE, WE'VE GOT A NUMBER OF OF ELEMENTS THAT WE WILL BE BRINGING TO YOU TO COMPLETE THIS PROCESS.

THIS PROJECT WAS IDENTIFIED IN OUR SANITARY SEWER OVERFLOW INITIATIVE, WHICH IS MANDATED BY THE TCQ.

THE PURPOSE IS TO REPLACE SANITARY SEWER LINES THAT ALLOW RAIN OR GROUNDWATER TO ENTER THE SEWER MAINS.

THIS PLACES A SIGNIFICANT BURDEN ON OUR LIFT STATIONS AND THE TREATMENT PLANT.

YOU CAN SEE EXAMPLES ON YOUR SCREEN OF THE INFLOWS HERE.

THE NEXT IMAGE SHOWS THE LOCATIONS OF THE PROPOSED PROJECT.

THE FIRST PROJECT IS REPLACING THE 15 INCH SANITARY SEWER THAT RUNS ALONG [INAUDIBLE] LANE, CONSTRUCTED IN THE EARLY 1970S.

THE NEW ALIGNMENT WILL BE FURTHER UP THE HILL AWAY FROM THE LAKE, WHICH WILL HELP WITH FUTURE ISSUES OF INFLOW AND ALLOWS FOR BETTER ACCESS TO THE LINE WHEN THE LAKE IS UP.

THE NEXT PROJECT IS IN THE AREA REFERRED TO AS THE NORTHEAST OUTFALL.

THIS INCLUDES THE SHORE CREST ACRES SUBDIVISION AND SOME ADJACENT HOMES.

THESE LINES ALSO DATE BACK TO THE 1970S.

AS NOTED IN THE MEMO, THE EXISTING SEWER LINES ARE 50 YEARS OLD AND VITRIFIED CLAY PIPE THAT IS NOT REALLY HELD UP VERY WELL IN OUR SOILS.

WE DON'T USE THOSE PIPES ANYMORE.

WHILE WE WERE DISAPPOINTED TO HAVE ONLY ONE BIDDER, STAFF FINDS THE PRICING TO BE ACCEPTABLE AND WE RECOMMEND WE MOVE FORWARD.
