Conditional Use Permit CU23-33 (7-Eleven) – City Council and Planning and Zoning Commission to conduct a public hearing relative to an application submitted City Council December 19, 2023 Page 2 by Jennifer Derenski requesting a conditional use permit to amend the previously approved site plan CU2019-02 (Ordinance No. 2019-006) for a master site development plan for gasoline sales and off-premise consumption of alcoholic beverages (beer and wine only) in conjunction with a convenience store. This request is specifically to revise the floor plan to allow for a Laredo Taco Company restaurant within the existing 7-Eleven convenience store and gas station. The subject property is located at 3580 North Grapevine Mills Boulevard and is currently zoned “CC”, Community Commercial District. ]

THIS IS A REQUEST TO AMEND THE PREVIOUSLY APPROVED SITE PLAN OF CONDITIONAL USE 1902 FOR A MASTER SITE DEVELOPMENT PLAN WITH GASOLINE SALES AND OFF PREMISE CONSUMPTION OF ALCOHOLIC BEVERAGES IN CONJUNCTION WITH THE CONVENIENCE STORE WITH GASOLINE SALES.

THIS REQUEST IS SPECIFICALLY TO AMEND THE FLOOR PLAN OF THE EXISTING 7-ELEVEN CONVENIENCE STORE TO REMODEL IT AND ALLOW FOR LAREDO TACO COMPANY RESTAURANT WITHIN THE EXISTING BUILDING ENVELOPE.

THE PROPERTY IS CURRENTLY ZONED CC COMMUNITY COMMERCIAL DISTRICT AND DEVELOPED AS A CONVENIENCE STORE, WHICH WAS APPROVED IN FEBRUARY OF 2019.

WITH THIS REQUEST, THE APPLICANT INTENDS TO RELOCATE WINE STORAGE TO ALLOW THE FLOOR PLAN TO REMODEL TO ALLOW FOR A 217 SQUARE FOOT LAREDO TACO RESTAURANT WITHIN THE EXISTING 3000 SQUARE FOOT 7-ELEVEN CONVENIENCE STORE.

YES, SIR. THIS REQUEST IS TO REZONE A LITTLE LESS THAN A QUARTER OF AN ACRE FROM THE HIGHWAY COMMERCIAL DISTRICT TO AN R SEVEN AND A HALF SINGLE FAMILY DISTRICT WITH THE PURPOSE OF CONSTRUCTING A NEW SINGLE FAMILY DWELLING.

THE APPLICANT INTENDS TO CONSTRUCT A NEW 3700 SQUARE FOOT SINGLE FAMILY DETACHED RESIDENCE ON THE PROPERTY.

HISTORICALLY, THIS PROPERTY WAS ZONED C2 COMMUNITY BUSINESS DISTRICT PRIOR TO THE CITY'S 1984 CITYWIDE REZONING, HOWEVER, IT HAD ALREADY DEVELOPED AS A SINGLE FAMILY RESIDENCE WITH ACCESSORY STRUCTURE.

THAT RESIDENCE AND ACCESSORY STRUCTURE WERE VOLUNTARILY DEMOLISHED IN 2022.

WE'RE GOING TO BE PUTTING A PRAIRIE STYLE HOME IN HERE, WHICH IS GOING TO BE REAL CONSISTENT WITH THE AREA, AND IT'S GOING TO BE A REAL NICE ADDITION TO THE AREA.

AND AT THAT TIME, THEY HAD ASKED FOR CHANGES TO THE PROPOSED ROCK AND BREWS RESTAURANT THAT IS ON LOT ONE, R4.

AT THAT TIME, THE DEVELOPER AND THEIR REPRESENTATIVE DISCUSSED A DESIRE FOR ADDITIONAL POLE OR PYLON SIGNS, AS THEY HAD SUBDIVIDED THE PROPERTY INTO MORE LOTS THAN THE THREE ORIGINALLY THAT HAD BEEN PROPOSED WHEN IT FIRST CAME BEFORE YOU.

AS A COMMISSION AND COUNCIL, THEY HAVE CURRENTLY REPLATTED THE PROPERTY INTO FIVE INDIVIDUAL LOTS, AND THEY'VE BEEN APPROVED FOR A TOTAL OF FOUR PYLON SIGNS.

SO IN ORDER TO ACCOMMODATE AN ADDITIONAL POLE SIGN, THEY ARE REQUESTING TO AMEND IT'S SECTION 60 SIGN STANDARDS OF THE ZONING ORDINANCE IN ORDER TO ALLOW FOR A SHARED POLE SIGN BETWEEN TWO LOTS LOTS 3R2 AND 3R1, WHICH IS SHOWN ON THE SCREENS BEFORE YOU. THIS TABLE WAS ADOPTED ORIGINALLY IN 1993, WHICH ADOPTED THE WILLIAM D TATE STATE HIGHWAY 121 CORRIDOR STUDY AS AN AMENDMENT TO THE COMPREHENSIVE MASTER PLAN. THE TABLE WAS A TEXT AMENDMENT TO EXPLAIN HOW ZONING AND LAND USE ARE REFLECTED IN THE GRAPHIC FORM OF A MAP.

THIS TABLE IS ALSO HOW STAFF DETERMINES IF A PROPOSED ZONE CHANGE REQUEST IS CONSIDERED, WITH APPROPRIATE WITHIN THE PROPERTY'S DESIGNATION, BASED ON DENSITY AND USE. THE LAST TIME THIS TABLE WAS UPDATED WAS IN 2017, WHEN THE COMMISSION AND COUNCIL ADOPTED THE COMMUNITY MIXED USE DESIGNATION AND THEN DESIGNATED 733 ACRES THROUGHOUT THE CITY IN FIVE AREAS.

THIS HAS BEEN WORKSHOPPED MULTIPLE TIMES AND BROUGHT BEFORE A SUBCOMMITTEE OF THE PLANNING AND ZONING COMMISSION.

MOST RECENTLY, IT WAS AT THE JOINT WORKSHOP OF THE COMMISSION AND COUNCIL ON NOVEMBER 27TH.

PLEASE NOTE THAT AT YOUR PLACE AT THE DAIS, YOU WILL FIND SOME CORRECTED INFORMATION RELATIVE TO THE ORDINANCE AND THE AGENDA MEMO THAT SHOWS THE NEIGHBORHOOD COMMERCIAL ZONING DISTRICT FULLY AND ONLY, CONSIDERED CONSISTENT UNDER THE LOW INTENSITY COMMERCIAL DISTRICT AND REMOVED AND NO LONGER SPLIT BETWEEN LOW INTENSITY COMMERCIAL AND THE COMMERCIAL FUTURE LAND USE CATEGORY.

THE DAY THERE ARE NO HOMELESS VETERANS OR PEOPLE STRUGGLING FINANCIALLY HERE IN DALLAS IS THE DAY THAT WE CAN MAKE IT JUSTIFIABLE FOR OUR OWN TAX MONEY TO BE FUNDING WARS IN OTHER NATIONS.

BUT UNTIL THEN, THE WAR BETWEEN HAMAS AND ISRAEL IS THEIR WAR, AND IT'S THEIR PROBLEM.

WE ARE HERE TO CALL FOR A CEASE FIRE.

YOU HAVE NO CAPABILITY.

NUMBER ONE, OVER 60% OF AMERICANS ARE IN FAVOR OF A PERMANENT CEASEFIRE AND ACCESS TO HUMANITARIAN AID INTO GAZA.

THIS NATION IS MADE UP OF STATES, AND THOSE STATES ARE MADE UP OF CITIES.

WHEN THIS NATION OR STATE DOES NOT DO ITS JOB IN REPRESENTING THE PEOPLE THEY CLAIM TO SERVE, IT IS INCUMBENT FOR CITIES, AT THE VERY LEAST, TO ASSUME THAT ROLE AND SPEAK UP AGAINST THE INJUSTICES AND ATROCITIES BEING COMMITTED USING ITS CONSTITUENTS TAX DOLLARS.

NUMBER THREE PASSING THIS RESOLUTION WILL ENCOURAGE A SAFE PLACE FOR ANYONE WHO ENTERS GRAPEVINE.

KNOWING THAT THIS CITY IS IN THE HANDS OF PEOPLE WHO VALUE EVERY LIFE DESPITE RACE, ETHNICITY, OR BACKGROUND.

MANY OF YOU HAVE PROBABLY HEARD OF THE SIX YEAR OLD BOY, WADEA AL FAYOUME IN CHICAGO, WHO WAS BRUTALLY STABBED AND MURDERED BY THE OLD LANDLORD, WHO WAS CONSTANTLY FED ZIONIST PROPAGANDA, AS WELL AS THE THREE COLLEGE STUDENTS IN VERMONT WHO WERE SHOT FOR SIMPLY WEARING A CLOTH LIKE THIS.

RESOLUTIONS SUCH AS THIS SEND A CLEAR MESSAGE THAT THESE ACTIONS ARE NOT INVITED IN OUR CITY.

SO I'M GOING TO GIVE A LITTLE JUST A RECAP OF WHAT THE COMMUNITY POWERED REVITALIZATION HAS DONE IN THE CITY OF GRAPEVINE FOR 2023.

SO WE'LL START WITH, IN GRAPEVINE, WE WORKED ON SIX HOMES THAT REPRESENTED 12 OCCUPANTS.

WE HAD 195 VOLUNTEERS FOR 1264 VOLUNTEER HOURS.

SIX ZONES OVERALL, SINCE THE BEGINNING OF THE PROGRAM HAS WORKED ON 850 HOMES, AND 31 OF THOSE NOW HAVE BEEN IN GRAPEVINE.

SO THESE ARE THE ANNUAL SPONSORS THAT WE HAVE AT SIX STONES THAT DONATE $25,000 OR MORE TO OUR ORGANIZATION, AND THEY HELP ALL OF OUR PROGRAMS HAPPEN. SO WHILE YOU MAY BE LOOKING AT THAT, LET ME TELL YOU SOME OF THE THINGS THAT WE ACTUALLY DID WITH THE HOMES IN GRAPEVINE.

SO WE REPLACED A LOT OF ROTTED WOOD.

AND SO WE HAD A LAWYER THAT IS FRIENDLY WITH SIX STONES THAT ACTUALLY DID PRO BONO WORK FOR US TO GET THE HOUSE TRANSFERRED INTO HIS NAME SO THAT WE COULD WORK ON IT.

AND BACK IN THE SUMMER, WHEN IT WAS 110 DEGREES, A TREE FELL IN HIS YARD AND TOOK OUT ALL OF HIS ELECTRICITY.

AND VERY KIND NEIGHBORS ALLOWED HIM TO RUN A CORD SO HE COULD HAVE AN AIR CONDITIONER IN HIS BEDROOM IN THE WINDOW.

BUT OBVIOUSLY THE HOUSE NEEDED A LOT MORE THAN JUST ELECTRICAL WORK AND THINGS LIKE THAT.

ELECTRICAL WORK IS A LITTLE BEYOND OUR SCOPE OF OUR PROGRAM.

SO WHAT WE DID IS WE ASKED A CONTRACTOR, WE GOT BIDS ON IT, AND GRACE ACTUALLY VOLUNTEERED TO GO HALVSIES WITH US ON PAYING A CONTRACTOR.

AND BUT LANCE, OUR [INAUDIBLE] PR DIRECTOR, WHO IS HERE TONIGHT, ACTUALLY WENT OUT AND GOT A COUPLE OF DONORS TO COVER THAT.

AND SO WE DIDN'T BUILD A CITY FOR ANYTHING RELATED TO THAT.

BUT WHILE WE WERE THERE, WE SAW THE OTHER THINGS THAT NEEDED DONE ON HIS HOME.

AND SO THAT THIS IS ACTUALLY THE HOUSE THAT, HAD LOTS OF WORK AND, UM, GOT A NEW ROOF.

SO THIS IS A VERY SWEET MAN, VERY GRATEFUL.

THIS SCHOOL DISTRICT HAS REPORTED BACK TO US THAT THOSE BOYS HAVE IMPROVED GPA, FEWER BEHAVIORAL ISSUES.

THEY IDENTIFIED THE NEED FOR DEFINITIONS AND USE SPECIFIC STANDARDS, PROVIDING DIRECTION FOR APPROPRIATE LOCATIONS FOR EV CHARGING STATIONS, BUFFERING TO ADJACENT RESIDENTIAL DISTRICTS AND USES SIGNAGE REQUIREMENTS AND AN APPROVAL PROCESS.

THE CITY COUNCIL ALSO APPROVED A SIX MONTH MORATORIUM AT THEIR MEETING ON SEPTEMBER 5TH OF THIS YEAR, WHICH WOULD EXPIRE IN MARCH OF 2024.

THIS AMENDMENT PROPOSES TWO DEFINITIONS ONE FOR ELECTRIC VEHICLE CHARGING STATIONS AND ITS SUPPLY EQUIPMENT.

IT ALLOWS FOR EV CHARGING STATIONS TO BE APPROPRIATE AND APPROVED THROUGH A CONDITIONAL USE PERMIT PROCESS AND SEVEN ZONING DISTRICTS, INCLUDING THE RESIDENTIAL, MULTIFAMILY COMMUNITY, COMMERCIAL HIGHWAY, COMMERCIAL, CENTRAL BUSINESS DISTRICT, LIGHT INDUSTRIAL, BUSINESS PARK, AND GOVERNMENTAL USE DISTRICT.

IT ALSO SETS FORTH SEVERAL USE SPECIFIC STANDARDS WHICH ARE NOW HOUSED IN SECTION 42, SUPPLEMENTARY DISTRICT OF THE ZONING ORDINANCE, AND THESE INCLUDE REQUIRING A BUILDING PERMIT PRIOR TO INSTALLATION OR CONSTRUCTION.

THAT CHARGING STATION PARKING IS IN ADDITION TO MINIMUM REQUIRED OFF STREET PARKING FOR THE PRIMARY USE OF THE PROPERTY AND LOT.

THAT SIGNAGE IS APPROVED THROUGH THE CONDITIONAL USE PERMIT PROCESS THAT NO OFF PREMISE SIGNAGE, INCLUDING DIGITAL SIGNAGE, IS PERMISSIBLE.

THAT CHARGING STATIONS MAY NOT BE LOCATED IMMEDIATELY ADJACENT TO PUBLIC RIGHTS OF WAY.

THAT IF LOCATED WITHIN 50FT OF ADJACENT RESIDENTIAL USES OR DISTRICTS, THAT SCREENING WOULD BE PROVIDED.

CONSIDER CALLING A PUBLIC HEARING REGARDING AM 23-8 ON SHORT TERM RENTALS TO AMEND THE COMPREHENSIVE ZONING ORDINANCE.

THIS IS A REQUEST TO CALL A PUBLIC HEARING TO AMEND VARIOUS SECTIONS OF THE ZONING ORDINANCE RELATIVE TO SHORT TERM RENTALS AND ASSOCIATED REGULATIONS.

IT HAS BEEN THE CITY'S CONTENTION SINCE 2017 THAT SHORT TERM TRANSIENT RENTALS, ALSO REFERRED TO AS SHORT TERM RENTALS, ARE NOT ALLOWED AND HAVE NEVER BEEN ALLOWED IN SINGLE

FAMILY DISTRICTS OR WITHIN THE ZONING ORDINANCE OF THE CITY OF GRAPEVINE.

THE STRICT PROHIBITION OF SHORT TERM RENTALS OCCURS BECAUSE THEY ARE NOT ACCOMMODATED UNDER THE EXISTING DEFINITIONS FOUND WITHIN THE ZONING ORDINANCE, RELATIVE TO ATTACHED OR DETACHED DWELLING UNITS.

OPERATION OF SHORT TERM RENTALS DETERIORATES SINGLE FAMILY NEIGHBORHOODS WITH THEIR INFLUX OF RESIDENTS, GREATER AMOUNTS OF TRAFFIC ON STREET PARKING, THE NOISE, LITTER, AND THE NEED FOR ADDITIONAL EMERGENCY SERVICES AND OTHER PUBLIC NUISANCES THAT ARE NOT NORMALLY OCCURRING IN OWNER OCCUPIED NEIGHBORHOODS.

THERE ARE INSTANCES WHERE THE CITY COUNCIL MAY FIND THAT ENACTING A PERMITTING PROGRAM FOR SHORT TERM RENTALS MAY BE APPROPRIATE OUTSIDE OF RESIDENTIAL DISTRICTS WITHIN CERTAIN MULTIFAMILY DISTRICTS, AND THEREFORE A DRAFT ORDINANCE HAS BEEN PRESENTED AND PROVIDED TO YOU.

IT WAS ALSO WORKSHOPPED AT THE JOINT COMMISSION AND COUNCIL MEETING ON NOVEMBER 27TH.

THIS AMENDMENT, AS PROPOSED TO DATE, INCLUDES NEW DEFINITIONS WITHIN SECTION 12 DEFINITIONS OF THE ZONING ORDINANCE RELATIVE TO [INAUDIBLE] SERVICE, HOSTING PLATFORM OPERATOR, SHORT TERM RENTAL, AND SINGLE FAMILY AND MULTIFAMILY SHORT TERM RENTALS, AND IT ALSO DEFINES SECTION 21, WHICH IS CURRENTLY RESERVED FOR FUTURE USE AND PROVIDES FOR USE SPECIFIC STANDARDS FOR MULTIFAMILY SHORT TERM RENTALS.

THESE INCLUDE PROHIBITION WITHIN SINGLE FAMILY DISTRICTS, ALLOWANCE FOR MULTIFAMILY SHORT TERM RENTALS UNDER CERTAIN CIRCUMSTANCES, LIMITATION ON THOSE HOSTING PLATFORMS AND BOOKING SERVICES, AND ESTABLISHING REPORTING REQUIREMENTS TO THE CITY STAFF.

IT ALSO ESTABLISHES APPLICATION REQUIREMENTS, AND IT ALSO ESTABLISHES LIMITATIONS WITHIN MULTIFAMILY DEVELOPMENTS TO 50 MULTIFAMILY UNITS OR MORE WITHIN THE RESIDENTIAL MULTIFAMILY ZONING DISTRICT OR RESIDENTIAL MULTIFAMILY TWO ZONING DISTRICTS CAN'T BE MORE THAN 3% OF AVAILABLE UNITS WITHIN THE DEVELOPMENT, AND NOT PERMITTED WITHIN THE HISTORIC TOWNSHIP.

IT ALSO CANNOT BE WITHIN 500FT OF PROPERTY ZONED FOR RESIDENTIAL, AND THE OPERATOR OF THE STR MUST BE THE OWNER OF THE PROPERTY OR THE REPRESENTATIVE.

THERE'S A WHOLE CAVEAT OF ADDITIONAL RESTRICTIONS THAT ARE OUTLINED IN YOUR BACKUP MATERIALS.
